  • Children removal

    Hi,

I have a situation that probably experienced by many. About 3 years ago my ex removed our children from matrimonial home and filed for divorce.
She requested the sole custody on a grounds that I never took part in children life's.

An OCL got involved shortly after, who reported that mother was manipulating children and in fact children preference was between father's sole custody or the least they would agree is shared custody.

Judge didn't like me having sole custody and he was inclining on share custody instead and asked us on SC "try to negotiate", we did, the OC withdrawn from communication on this, we had another SC, another OCL, and another OCL and another OCL - everyone was saying pretty much the same thing - mother manipulates kids, and they want to be with father. Eventually she agreed on 50/50.

The few questions I have here:
    1. Almost 3 years of children life's went without father, on a bogus claim from my ex that they wanted to be with her, despite OCL reported otherwise.
    2. The judge has allowed me 2 hours visitation, as if I was a criminal or something, but I wasn't guilty of anything - just words of my ex, despite OCL has very early reported children's preferences he did nothing.
I ended up getting 50/50 custody which I have offered the first week after she moved out of house, so I should be happy that I got what I wanted, but no one cares about children's experience in those 3 years.

Is there anything could be done here?

You have 50/50 now? What happened is over. You cant go back and change it and you cant have her punished. At least you see your kids now and can build a strong relationship. When they are old enough they can choose to live with you full time.

it is on consent - not a judge's order, and we haven't settled yet, and she continues badmouthing me - even OCL confirms that. Court doesn't seem to care the present or past, and this isn't even my words against hers, but OCL against her words.

There really isnt anything you can do until you can present it to a judge. Keep letting your kids know you love them and that they should not be involved in adult discussions etc.

You have the benefit of the kids telling you this stuff and still wanting to be in your life. It would be worse if they believed what she said and chose to stop seeing you.
