    Good afternoon,

    I have sponsored my ex to come to Canada, and eventually, the marriage didn't work out and he returned to his home country. He processed the divorce there, but I haven't done it here in Canada. He did, however, send me a notarized copy of the finalized divorce. We did live together for more than a year here in Canada, as he was on a visitor's visa, and eventually got his PR card. We got married overseas in his home country, not Canada.

    The reason I am mentioning all of this is that it's been a couple of years since we parted and I am in a new relationship, which is heading for a marriage. At first, I thought it would be sufficient just to divorce in the country where we were married, but now I am wondering if I have to file for divorce here in Canada as well before I am able to remarry?

      You need to speak to a lawyer and request an opinion letter on foreign divorce to be able to get your marriage license.

      Info that will be required:
      - both your and your ex's current address
      - copy of the divorce decree (the original, or a certified copy, are needed to get the marriage license anyways)
      - documentation from your ex proving that he lived in that jurisdiction, such as utility bills

      Call around to local family lawyers; the cost for this should be about $100.
