  • STBX's Request for Information -Are there limits to Requests ?

    Hi all,

    STBX's counsel asking for a ton of stuff, including all emails between me in business partners, ever.... WTF !? Not that I have anything to hide, but this is ridiculous.

    Are there no limits on what type of information they can ask for ?

    Why are they asking for the information? To determine cs amounts?

      3.6.1 Document disclosure, request to admit, and questioning

      If a party believes that another party’s financial statement does not contain enough information for a full understanding of that party’s financial circumstances, the requesting party must first ask for the additional information (r. 13(11)(a)). This can be done by letter although it is better to use a Form 20 – Request for Information, the original of which should be filed in the continuing record with proof of service. If the information is not provided, the requesting party can bring a motion and ask for an order requiring the respondent to provide it (r. 13(11)(b)). In the event the order is not complied with, the court may dismiss the respondent’s case, strike out his or her Answer, make a contempt order, or order that any information that should have appeared on the Financial Statement not be used at a motion or trial or any other appropriate order (r. 13(17)).

      They can request anything. But, will a judge grant it? Hard to say... But, when it comes to determining child support they generally order the requests.

        she pays me CS. Not sure why she is asking for emails between me and my business partners. maybe because she thinks I was scheming which is ridiculous.

                Im wondering if theres an argument about privacy for your partners. That sharing that info is a breach of their privacy?

                But really shes trying to determine your full income for the s7 split and you would think that your full tax return and business financial statements to show expenses would be enough. I dont think you would have an email thats says "hey partner can you hide this hundred mil for me from my ex?"
