  • I posted this already but had no rerply

    can a witness be supeoned by both sides in nova scotia. I want to supeona
    a witness that the other side in my case may want to supeona.
    I thought that if I supeona that person first I will have control over wheather that person takes the stand. Is that true ?
    I posted this already but had no rerply if someone could take a look and give a reply it would be helpfull.

    If....

    you don't receive a reply i would contact the Nova Scotia court offices someone there should be able to assist you.

      dvr,

      I would take the lead and subpoena the witness. That way your guaranteed the witness will be there to support your stance. It does not matter which side calls the witness as same will be subject to cross examination.

      I also believe the court could also call any individual as a witness if the court believes they may have significant first hand information about the case.
