  • Requesting file from laywer

    I'm now self represented and would like a copy of my file from my lawyer.

    Do I have to pay for this?

    If you owe her nothing, I believe she's supposed to hand it over to you.

      No, you should not have to pay for your file - but make sure your account with your lawyer is paid up. I did this awhile back.

        Agreed. Assuming your balance is zero, the file is yours for the taking. I had no issue getting my files from two lawyers... I just had to schedule a time to pick it up with the receptionist... To ensure it was packed up and ready.

          Very true. If your bill is paid in full, the work is yours.

          If you owe anything at all, the lawyer does not have to give you work that is unpaid for.

          If you have provided the lawyer information, receipts, papers, etc., those belong to you and you can have them back.

          Anything he/she created still belongs to the lawyer until paid.
