  • Parenting not an issue

    Hi I have requested sole vs (my ex)joint

    However, no applications have been brought forward no motions nothing.
    to date by ex.
    In saying that it is in my court application along with spousal and child support.

    I wanted to submit some educational info to prove the children are thriving in my care but my lawyer said it wasn't necessary as Parenting is not an issue?!!
    Anyone have an opinion about what that could mean in court?

    Your parenting is not the issue, unless your ex has custody and is trying to deny it to you.

    If you are going to try to get sole custody, you must prove that he is an unfit parent.

        What does unfit mean? Verses not interested parent?

        No address, no visiting schedule, no parenting plan, didn't pay child support until court order was enforced.

        Cancels visits
        Moved across the country and left his wife and children behind never saw them or requested them for close to 7 months.

          Have you asked him if he wants joint? Your ex sounds like mine. He never asked for joint. He had no interest.

                  None of these things make him an unfit father. It would appear that he has had a change of heart in terms of his level of interest in the children if he as gone as far as to seek joint custody.

                        I could believe the change of heart had he of brought forth a motion or an application or even requested more access through his lawyer, none of that has been applied.

                          Good luck with whatever happens. Wether its by his choice or something you intentionally do, a missing parent is not something easily over come. My d9 hasnt seen her father in 3 years. He rarely calls or emails etc. Im sad for her.

                            You served him with sole, he responded and asked for joint... why would he have to start a new application for joint?

                            I guess the biggest thing is, how much are you willing to spend/fight about this? Do you truly understand the difference between joint/sole? Not being rude, but a lot of people don't. You may still have majority of access but have joint custody.

                            Another option is to make a parenting plan, where you have joint, but you have final say on some issues and he has final say on other.

                            What reasons do you have against joint?

                            Now think of some POSITIVE reasons for joint.

                            What reasons do you have for sole?

                            Now think of NEGATIVE reasons for sole.

                              If you submitted an application, he wouldn't do any of that. He would just presumably file a response to your application, and it sounds like he did?
