If a partner relies on extended health benefits then delaying a divorce would be of benefit (no pun intended).
My lawyer said having a divorce separated from the corollary issues isn't a problem. His thoughts is that staying "just" separated trying to work things out just prolongs everything. Now that could be specific just to my situation.
Some people think that if you don't separate the issues, they get settled faster because usually one person wants the divorce a lot and so they are motivate to compromise because they want the divorce.
To sever an issue means to deal with it independently, to its conclusion, without needing to resolve all of the other issues. Because most remedies - particularly for property - are under the Divorce act, they are "corollary" issues because the divorce is the "main" issue. No divorce, no access to other remedies - hence no property rights for common law couples, as they cannot divorce.
What is the strategy in doing this?
Some people just want the divorce. It conveys neither advantage nor disadvantage.
It is a requirement of remarriage, however. It can be part of emotional satisfaction; you are not longer separated from your spouse, nor are you committing adultery by dating. The marriage has ended.
