Legal Briefs and Citing Case Law/Jurisprudence

Folks,

Anyone on here have any good examples/templates on writing legal briefs?

I need to know the format used?
How to write case law in support of your statements as it relates to your statements?

If you are using Microsoft Word, go to the "References" tab and look over to the right and see "Insert Table of Authorities." This will format everything for you correctly.

For examples, see the links in the stickied threads. Especially read EVERYTHING in the Factum thread; click on the links and read the pages in full.

Follow the link to the Wilson Moot and find examples.

Go to Canlii and do a search using your local courthouse as one of the search terms, and some important element of your own case (ie "Custody".) Find cases that were somewhat similar to yours. Write down all of the reference information and go to the courthouse and ask to look over the file.

Treat self-representation as both a full-time education and a full-time job.

Great, thank you Mess. Little bit of topic, for cost submissions do you know if they have to filled with the court or just faxed to the Judges Secretary? (Cost submissions after a Motion) If they have to be filled are they served are the in the continuing record? do they need affidavits?

I totally agree, last year I had three full time jobs.
1st job: Dad
2nd job: Legal researcher and educator.
3rd job: My real full time job.

And literally I spent more time legal researching than on my real job.

My our children came over, everything was put on hold till they were in bed, then it was get the legal research out. Read case law, read lawyer training material.

When the children were at mom's tI'd go to the locate court house and listen to the judges, when I had a sick day or time off from work. Drive to toronto and listen to motions or trials.

I took the following stance.
My child has cancer, I need to know everything about every kind of treatment with regard to this cancer.

in mycase it was family court. I need research everything about "Best interest oif children", section 24 of the CLRA and custody and access.

Thats how I ended up with equal shared, and paralle parenting. EWven though the OCL was against me, and there was 5 CAS calls against me.

If you find caselaw simular to your case then write the lawyer and or the person and ask about how they did it, and now that they are done what did they learn and what would they do differently.

Smart advice! I would suggest emailing them so you can be assured a response. But a very sly way to get ones foot in the door!

mine was 14 days long, self represented against another lawyer, no it was not on consent. LOL

And the reasons were given orally so it will never appear on canill.
