  • Changing a Final Order

    I went to Trial in Sept 2011 to deal with Section 7 expenses ... to clear up what was and what was not covered. Got a final order that's pretty clear and straightforward.

    My question is ... under what grounds could my ex file a Motion and win? I know if there is a "Material Change" but what if there is absolutely no change. Same job, same living arrangements, etc ... would he have any chance? Other then saying "I don't want to pay anymore" if nothing changed other then his income increasing a bit in the past 18 months what are his chances?

    At a quick glance, I'd say that his chances are pretty piss-poor.

      He has to demonstrate a material change as part of his motion in order to be successful. However, he can file a motion at any point, he's allowed to do that.

      Your response would simply be that there has been no material change in circumstances since the order was made, and request his motion be dismissed with costs.

      A halfway competent lawyer would eat him alive.
