    "Time is money" is attributed to Benjamin Franklin. Kinda ironic that it is his face on the US$ 100 bill then...
    Can anyone point me to the section of the CLRA or Divorce Act that states no parent shall withold time for the purposes of maximizing CS?

    Maybe in the Divorce Act?
    I vaguely remember seeing something about this but can't recall where. I have had a look and come up empty.
    Anyone else, any thoughts?

      Wish I could help, I have never seen that. Although, i'm sure a few people could use that information, as you hear about it happening so much. I will dig around and see what I can find on that for you.

        This doesn't specifically say what you are looking for, but take a look:

        Order where child unlawfully withheld
        36. (1) Where a court is satisfied upon application by a person in whose favour an order has been made for custody of or access to a child that there are reasonable and probable grounds for believing that any person is unlawfully withholding the child from the applicant, the court by order may authorize the applicant or someone on his or her behalf to apprehend the child for the purpose of giving effect to the rights of the applicant to custody or access, as the case may be. R.S.O. 1990, c. C.12, s. 36 (1).

          It is a general principal found in case law. Easy to find on CanLII hundreds if not thousands (federally) of orders outlining this very simple principal.

          Also, check the Child Support Guide Lines it may have the details.

          It is such a basic principal to custody and access that it rarely happens.

          "Your honour, parent X didn't pay child support so I won't let them see the child." - NEVER be this litigant denying children access to a parent due to child support non-payment.

          Also, it is a contemptable conduct to withhold a child from an access visit that is court ordered.

          Although child support is the right of the child... The child also has a right to access to their parent. Access and the payment of child support are mutually exclusive and should not be mixed. Access should commence even if the other parent is not paying CS.

          Access is NEVER a bargaining chip in Family Law and judges don't find it funny at all.
