  • Ex won't pay equalization etc: What to do?

    Ex won't pay:
    Equalization payment ordered 6 mths ago
    Another payment for merchandise ordered Oct/2011 due "immediately

    So far I have not seen a penny. What can I do?

    No dates were given on the equalization but Judge said it's presumed 30 days.

        By the way, these aren't child support or spousal support, this is an equalization and other payments.

          Oh, okay. I misread your post. I don't have any knowledege or experience in this area; however, I did find this on the web:

          What about failure to make an equalization payment?

          This can be enforced several ways. One way is a garnishment of your spouse’s salary. Another way is a writ of execution on a property owned by him or her. The writ of execution allows the sheriff to seize and sell the property, with the proceeds going to you.

          I'm assuming, but you could likely apply to the court to take action on his pay or property. Just write an affidavit with the order attached, and specify that your ex has not complied.
