  • Financial disclouser

We are going thru a divorce....and ex will NOT do the financial disclouser....we are going to court now... what if he lies on his financials... is there a way to verify his financials... I have heard people hiring PI...any idea how much they costs...

I find it disgusting that I have spent ton of money to pay legal cost...because he choose not to co-operate... can he held resposible to pay part of my costs...

    Hi New Beginning,

You raise a lot of different issues!

Regarding financial disclosure, there’s an obligation to make full and frank financial disclosure. Of course, this normally doesn’t happen and there are lots of delaying games people pay. But if you’ve got a lawyer who’s persistent, you’ll eventually get the financial disclosure. I don’t know enough about your case, but I wouldn’t be surprised if one of the things your lawyer is going to be asking for at the upcoming court appearance is an order that your ex provides you with certain documents within a specified time frame.

Regarding hidden assets, a lot really depends on why you suspect money is hidden and how much might be hidden. This is because there are so many ways in which money can be hidden, that you need to narrow the investigation down somehow. A PI isn’t usually the first step in this sort of situation. A divorce lawyer can help you with some of the basics; if the situation is more complex, you could get help from a forensic accountant.

Regarding costs, at the end of the day, if a judge decides your case, he or she will most likely make a decision as to whether your spouse will be responsible for any of your costs (or vice versa). One factor a judge takes into account is the conduct of each spouse, including failure to provide financial disclosure. However, if you settle out of court, which is what happens in most cases, normally as a compromise each person pays his or her own costs.
