Default No Case Conference Brief from the other party?

I have my second case conference on Monday. I served and filed my brief to the other party, and sent in my Confirmation.

I haven't received anything from the other party.

We are both self-represented.

I called the court office yesterday and they told me I still have to attend on Monday.

I can't see him just not showing up for court.

Can he serve me the documents on the Conference day?

What will happen if he does show up, empty handed?

Sadly, he can serve you the documents on the day of your conference. And nothing will happen... at best, he'll get a mild scolding.

This happened to us too. We got served the brief and financial statement the day of court. And the conference went on, even though we didn't have a chance to review the documents.

In retrospect, we should have asked the judge - or been more insistant - to adjourn to another date so that we had a chance to review the documents.

I suggest you call the court house and explain the situation (or go early to speak with the clerk on Monday, since you'll have to be there) and ask the clerk and duty counsel what you should do.

Sometimes this tactic is used to cause delay resulting in adjournment in my experiences. Nevertheless, Be sure to seek costs at that appearance.
