  • Rule 8 Failure to Follow Rules or Obey Order

    My ex has owed me a fair amount of money for extraordinary expenses for 10 months. I was going to start a contempt order but have learned thanks to this forum it does not include arrears. My question is what forms do I need to do a RULE 8 Failure to Follow Rulers or Obey Order motion.

    Any help is needed. I haven’t had to use this form for a few years now but my ex feels she is above the law.

    What does your order say as far as s.7 expenses?

    You may want to have the expenses set and to proceed through FRO for collection.

      We are to pay 50/50 of S.7 and extraordinary cost. I always pay for the whole thing and fight to get the money from her afterwards. This time we’re into 8-10months and she has told me she doesn’t have the money, yet she’s gone on a trip to the states and just got a new dog.

        We are to pay 50/50 of S.7 and extraordinary cost.
        What does it say about:
        - proof of expenses?
        - consent from other party before incurring the expense?
        - defining what is s.7 and what is a regular expense?
        - timelines to pay?

          Both parties must mutually agree on expense otherwise disagreeing party does not have to pay. All expenses she has agreed upon.
