  • Office of the Childrens Lawyer....

    We have received a response from common law husbands exwife...in it she is asking for sole custody, which we knew was coming but....she has also requested that the Childrens Lawyer get involved. Perhaps I'm wrong but isn't that a little odd, I could see if we have filed to have their son come live with us but...

    It was always my impression that the childrens lawyer works on behalf of the child and their interests, assesing both home environments and speaking with both parents as well as people who play a consistent role in the childs life. Am I correct on this?

    And since I'm here something else I'm wondering and perhaps I could get some opinions..she has a disease which is generally very managable so long as you take reasonable care of yourself. Well she hasn't and her health has suffered for it, but she has made greater efforts and is doing relatively well..the only time she does become ill is of her own doing. She stated in her request for spousal support and I quote "that she is very ill and is in need of several medications daily to keep her alive". Using that statement, wouldn't she be automatically be putting forth a question of her ability to take care of her child??

    Generally they will complete a comprehensive parential assessment of each parent's household and comlete a final report or recomendation on custody and access issues. I have read some cases where the children's lawyer only interviewed one household and their report was basically ignored by the court.

    The court may order a request for their involvement, but ultimately the office of the children's lawyer reserves the right to take on any case. To get a head's up on their process, read their criteria intake form
