Whose Responsibility is it to update Court Order for FRO?

    New Question on this topic..........If a non-custodial parent automatically pays FRO their Child Support increases month after month/ year after year.........and the Recipient NEVER updates the Court Orders each year for the increases, what happens when the children are 18-22 and no longer eligible for Child Support?

    (All that money accumulates in the FRO account)........Does it get returned to the Payor? Does the Recipient Parent receive the lump sum? or do the Children receive the lump sum?

    An amicable Ex Couple told us that he had a Few thousand extra dollars accumulate at FRO and the Mother had to Sign something for FRO to return the money to him.
    (Maybe the children were not finished with Child Support in that situation?)

      My partner was told that if the amounts werent claimed, they will return them to him at the three year mark. You may want to call your caseworker.

      In the case you were told, it could have been that they werent eligible for support and he was being garnished while they were investigating. That does happen where they tell the payor to continue making their payments but the money will be held. If the recipient cant prove eligibility, they return the held money. Not sure why they needed the recipients permission.
