  • asking for a friend.ex left country ,house being financed by spuose only

    just need a quick question if anyone knows about this info.

    Spouse left country 4 years ago,house is paid off here.spouse here is paying all taxes and no support for 1 child,no contact from spouse at all .

    Would spouse here be able to sell house after so much time has passed as other spouse is not canadian status and no visa here.

    Is there a time limit that can be used as abandonment ..to sell house and move on,before spouse spends thousands on lawyer here to start.

    International issues are complicated, and often require lawyers.

    My guess: You can't just sell the house if the ex is still on title. Your friend should go through the equalization process, and then perhaps ask for the equity in the matrimonial home as a sort of lump sum child support payment.

      Janus is correct. You would need to bring forward an application. From there you would have to go through the motions until you can get to an uncontested trial. This is not a "basket case" (aka slam dunk). The courts like to give parents all the opportunity in the world to respond. They hate making orders that are uncontested. They are easily overturned if the other party shows up.
