I have a few documents, including 2 Offers to Settle (OTS), that I served prior to the trial but when I tried to file them at the Family Court counter, they refused them and told me that I couldn't file them as they were:
a) prior to the trial: too close to the trial as the file was at the Trial Coordinators office,
and
b) after the trial: I was told the trial is done so they wouldn't take them,
Our written submissions (instead of closing statements) are due early March and my OTS all have Affidavits of Service from serving them prior to the trial. Counter staff knows this.
Prior to the trial, a duty lawyer had told me to have the signed OTS along with its Affidavit of Service in my file so when the case ends in my favor at the end of the trial, that I show them immediately to the judge.
But that's not how it ended... so how can I have the OTS in the file so the judge can see them?
Does the judge call us in when he does the judgement and we submit it then?
I am doing a Notice of Motion to have my STBX provide Form 20 documentation that he should have done for the trial.
Will that fly?
Can I add the OTS to be filed as part of that motion? Or?
Do I do a cost submission along with my case law/summary submission? Or can that follow?
