    I been seperated from my x wife since 2003.We have a seperation agreement dated nov 2004.Well i recently tried to get a loan and was turned down because my name was still on the mortgage,well was i surprised.In my seperation agreement it states that i was suppose to be released from the mortgage within 60 days.My new lawyer says she can't take care of it because legal aid won't pay for it ,she says that my old lawyer screwed up big time.My name is off the title of the house but still on the mortgage.Well i wrote him a letter telling him to take care of it and i'm still waiting for a reply.I want to know how hard will this be for him to take my name off the mortgage and what exactly does he have to do to get this done.I also want to know what to do if he says screw u i got your money.I would think he would be legally obligated to take care of this because thats what i paid him for.Any information on this would be greatly appretiated.

    This type of oversight usually gets taken care of as promissed, except there may have been a screw up.

    Usually, banks don't just take one person off the mortgage just because one of the parties feels like it. You usually have to refinance the mortgage to do that, and it involves fair bank fees.

        getting you off the mortgage was something your ex and your banker were supposed to do. There are usually banking fees involved, and your signature is needed for the bank.

        Lawyers can usually take care of mixups at city hall with title registration all on their own, without fees, but not bank mortgages.

          Getting my name off of the mortgage was something my expensive dumb lawyer was suppose to do as it was stated in our seperation agreement.Do you really think my ex wants to get her own mortgage ,she dosn't even have a job knowbody would give her a mortgage.
          My lawyer dropped the ball on this not the bank.
          Know my lawyer is trying to screw me again by saying "your ex is in contempt of court" This is a ploy of his to charge me more money.
          It was his job ,thats what i paid him for.
          He didn't tell me oh by the way in 60 days you have to check with the bank.
