  • Strike pleadings - who obtains follow up evidence

If someone gets their STBX pleadings struck, can they ask for an order to get financial info from banks, mortgage co's, life insurance co's, etc? If so, since this would be done by mail inquirys, does my lawyer have to do this work or can I do it to save costs?

If your ex were to appear in court (I believe you were having a problem serving him as he had released his lawyer), you could attend with blank release forms for the bank, the insurance company, mortgage company, and request judge have him sign the release forms.

We had a difficulty in getting my ex to produce documents and therefore one judge we appeared before ordered my ex to sign the release forms that very same day.
