    I am new to this site and just came across it. I have been separated for about 6 months now and am unsure as to how to proceed.     I am not clear on your issues other than what you have mentioned that you have two small children; It appears custody, access, child support, spousal support may be some of the issues to be settled.

    Separation Agreements

    Two parties may enter into a separation agreement to determine such issues of custody, access, child support, spousal support, net equalization, property division, pension division etc.

    To validate the separation agreement, it should be made in writing, each party gives to the other full financial disclosure of all assets and liabilities. The agreement when signed by the parties should also be witnessed by a third party. Each party to the agreement should seek independent legal advice to ensure that they fully understand their rights and obligations.
