  • What constitutes post secondary education?

My oldest is turning 18 next month. After high school he is planning an apprentiship course which is 1 week school and 1 week work placement. My ex is under the impression that this course does not constitute post secondary and is planning on going back to court to remove her support obligations. Is she wrong?

I came across this case which appears to be similar to your situation.

    Charron v. Fulham, 2004 CanLII 14136 (ON S.C.)

Read Paragraph 5 of the Judgement.

and of course the subsequent issue of costs

Neither case would seem to apply as his work placement would pay minimum wage if anything and working only every second week he would still be a dependant.

Its a unique situaton and anytime one has to resort to the courts for resolution it is a gamble.
