It would have been nice if there had been a statement as to which parent gets the credit where the parents are separated, but I would suppose it's the parent with primary residence. Hopefully it would be shared in cases of shared custody.
I was reading on the q and A of the site that the person who receive the CTB for the child will receive the daycare amount.
Moreover, the criteria is: the child is age 6 and under.
The ironic thing is every parent who receives the CTB for a child age 6 and under will receive the daycare amount. The child does not even have to be enrolled in any daycare. It is free money and can be spent on anything.
It is of my opinion that each part of the divorce laws were crafted in isolation... and that each part of the tax laws regarded divorce were also crafted in isolation (so.. isolation within isolation).
Oddly too, there is a backwards ripple effect starting with CRA laws/forms that affects almost everything further up the Divorce ladder.
I have zero repsect for Family Law and CRA (regarding divorce). It equates too much to a Monty Python sketch.
