  • What to know before I leave

    I am new to this forum and I believe I need to get a divorce. I have a child who is 3 1/2 which is what I am most worried about. If I leave the home and take the child, can I be sued for abondenment? And if I am what does that mean to me and my child? What other risks are involved with me leaving? If I stay, what happens? Should I stop paying the rent and get evicted? I don't really want to do that b/c I want to keep a good rental history. I don't even know where I would go? Or what steps to take to get out? I only know that my husband is a mean nasty drunk and he has no money to speak of. He has not hit me yet, but I imagine it will only get worse with time. In addition, he plays games with my head and loves me so one day, and doesn't come home the next. I am having a terrible time emotionally and physically and I feel terribly guilty leaving him because I don't know what will happen to HIM.....

    It appears you may be a victim of emotional abuse. If you leave, yes indeed take your child. If you leave the child with the other parent in the face of the facts, you are essentially giving this party the authority to act in your absence as a defacto parent.

    If you do leave with the child, make arrangements for the child to have some kind of contact with this parent. ie: if you have concerns of harm, emotional, physical etc then arrange for supervised contact. Many communities offer supervised contact. Moreover, be sure to keep the other parent informed in regards to the child's health and welfare. Send them a formal letter by registered mail in this regard.

    ""If you stay" If you attempted counseling and it did not work and the emotional abuse is continuing, then you have no other choice but to leave.

    If you have no place to go, every community has emergency shelter's. You could get a list by calling the nearest branch of the Ministry of Community and Social Services.

    If you need emergency financial assistance, the Ministry of Community and Social Services can assist you.

    One thing is certain, no one should have to put up with abuse of any kind.
    I would not worry about your current residence and your rental record. Your health and your child are more important right now.
