Divorcemate has recently put out a free online calculator for spousal support. The website is mysupportcalculator.ca.
I have been one of Divorcemate's most vocal critics and I continue to be. They put all these disclaimers on here that it is a starting point for discussions...bla bla bla
The bottom line is this. If you use this, more than likely it will calculate a spousal support number that is way too high.
The reasons for this could be many - example - higher inome spouse may be paying for benefits for recipient spouse (that's a deduction), line 150 income may not represent income subject to spousal support, there could be debts at the end of the relationship, one party could be eligible for the disability tax credit, childrens fitness tax credit, child care expenses.
I could go on and on and on...
And ask yourself this question. If it's so good, why do they continue to have a paid version for lawyers only? That is what the courts use - not this calculator.
This does absolutely nothing to solve the immense problems in calculating spousal support that Divorcemate causes.
I have identified 4 levels of incompetence and criminality in the law profession.
(1) The spousal support guideline creators were not qualified to design the guidelines.
(2) Even assuming the SSAG is correct, Divorcemate has made programming errors. Recently they made an adjustment to a corporate owners salary stating it has double CPP and no EI unlike an employee who has single CPP and EI. Guess who told them about that? Me. One year before they made the change. There are dozens of other errors in the programming that they still have not changed.
(3) Even if Divorcemate's programming is right, lawyers lack the intellectual competence to enter the information correctly. I have looked at dozens of cases and I have yet to find a lawyer who can enter the information properly.
(4) Judges are completely clueless and will generally select a point halfway in between what both lawyers calculations say and choose the midpoint.
Is it any wonder that there continue to be wars in Family Court over spousal support? And who benefits? Lawyers. I know of no other profession where the dumber you are, the more money you make. Ok well maybe politicians but most of them are lawyers anyway.
