  • draft order - ten days

We served a draft order on 17 April. There has been no response from other party's lawyer to date. According to the rules after ten days we can ask the court to issue the order. I just want to be clear, the ten days starts on 18 April and includes each Easter holiday. So the ten days ends on 27 April and we can file at Court for final order on 28 April?

    the ten days starts
Depends on your method of service. If fax, then yes.

    includes each Easter holiday.
If a timeline is for less than seven days, you only count business days. For seven or more days, each calendar day (including holidays) counts.

we can file at Court for final order on 28 April?
    Technically yes.

If there is anything uncertain about the Order, you may wish to contact your ex's lawyer to see if there will be any problems, or if the signed consent is coming to you by regular mail. Having the draft order approved shortens the time frame.
