Hello all, I am back with another question. My wife has been selling property out I my home, I was informed that she was trying and I had my lawyer instruct her that she is to not sell anything. Now I have just recently gone back into my home and found property missing (sofa, chair etc.) this is all after she got the order to not sell any marital assets. NOw here is the fun part, I let the home because she "accused me of assult" and I was removed from the police. when I went into the home to collect belongings, I took 1 of our 3 big screen TV's, she had me arrested for theft and I was released as I told them I was not selling it, that it was still marital property. What can I do

Thought about calling for police escort?
My understanding, is that if you call the police and give them least 24 hours notice (beter to give at least a few days) and tell them that you are going back into the matrimonial home and need police to be there due to the situation in order to pick up your personal belongings, they will meet you there and you are entitled to do so. Of course, you can't take all day to do this...just a quick 20 min or so stop to pick up your clothing and personal items and some personal possessions - things that do belong JUST to you; not an all day thing. This ensures that they don't have to come back later with 2 or 3 cruisers later on for a serious domestic dispuite. :-)

On the theft charge - I think they will have a difficult proving such considering at least you are joint owner of the TV. Did they also charge you with breach of recognizance?
