    Hi community,

    as some of you may remember, STBX is now attempting to amend claims with a tort, claiming whiplash (happened 5 years ago).

    I have several affidavits directly refuting her set of facts. There are also people which have expressed varying degrees of willingness to act as witnesses.

    So my question is, if someone does not want to be a witness, can they be subpoena'd ? Some of these people would naturally take the side of STBX, eg. my ex brother in law, none the less their witness account if truthful would exonerate me.

    Can a subpoena be ignored ?

    A subpoena cannot be ignored. However, I'm not sure having a hostile witness is the way to go without experienced legal counsel. It has often been said that you should not put a witness on the stand without knowing first what the person will say.
