    Does my husband have to pay for child support even though we have a large sum in RESPs? Our daughter will be attending university next year and will be living away from home from Sept to April. We have approximatley $120k in each of the children's RESP accounts. Of the $120k, $70K must be claimed by the child because that was incomed earned. $50k could potentially go back to us because that was the principal put into the account.

    Yes, he still has to pay child support. One would assume that her mother still must maintain a home for her where she will be living when she is not in school.

    Education falls under section 7 expenses, not child support.

      Legally he's responsible. But unless you have an order in with the FRO, then it's up to the custodial parent whether they want to collect, or not.
