  • simple uncontensted divorce question

    hi Friends,
I have been married since last one and a half year now..no kids, in ontario.I want to file an uncontensted divorce application, but it states that we should stay separate for atleast 1 year before I apply. So does that mean,I cant apply now, start staying separate from my wife and apply after one year??
    Thanks
    Mick

To my understanding, you have to be separate for 1 year before you apply unless you are divorcing on other grounds such as adultery or mental and physical abuse.

Hi mickscool and welcome to the forums!

Yes, you need to be separated for 1 year prior to your divorce being granted. However, if you're trying to get things done as quickly as possible, you could start about 2 months before that to ensure that your divorce happens as quickly as possible after you hit one year.
