    another question...

    I was served the court paperwork last night March 8.2010.

    The paperwork was signed by the applicant's lawyer Feb 11/2010 and court date selected for March 30/10.

    I am supposed to respond in 30 days, but based on how slow they served the documents- almost a month, I am left scrambling.

    Is this right, can I get an extension?

    The easiest way would be to get an extension on consent. Your ex would have to agree to the adjournment. All you have to do is call up the trial management office at the court you are attending. However, they will only change the date if both parties are in agreement on the change.

    But it sounds like you might have been deliberately served late?. You might want to check with the clerk at the court you are attending. Explain the date that you were served and the fact that it doesn't give you the time that you are entitled to respond adequately.

    Do you have a lawyer? If not, you could hire someone and they would be able to argue, given that they have only just received your file they have not had an opportunity to read up on your case and prepare. On that basis you could get an adjournment.
