Since our separation and divorce is completely uncontested and without issue, we are going ahead without lawyers and using the Ontario Divorce Kit.
In the instructions it says, "you may begin the divorce proceeding as soon as you are separated as long as the separation has lasted for a year or longer by the time the case is heard by the court."
My question is, we became officially separated end of October 2009. When would we need to file the divorce papers so that when the court hears/reviews them we would have been separated for that 1-year period? If they're filed now, and they come up for review by the courts and we haven't reached that 1-year mark will they set the file aside until that date, or will we have to go through application process again?
