  • Voicemail Evidence

How do you add recordings (wav files) as evidence? Due you burn them to cd and provide the court and the other party with the CD?

Also Can new evidence be added between Trial Management Conference and Trial?

I encourage you to look into whether you can even have voicemails as evidence. We thought we could. After all, it's admissible in criminal law cases. But we were recently told by a family lawyer that recordings are not admissible in family law cases. (Which is most likely why my stepson's mother has recently refused to communicate in writing... and only leaves messages on our voicemail - because she knows that without written proof, there is no way we can hold her to her word. It's pathetic... I know... and so very frustrating when you can't trust someone to follow through on what they say.) Look into it first with FLIC even, and they should give you some suggestions.

Hi #1StepMom, Did your Lawyer explain why voicemails cannot be used as evidence?

No. Simply told us that voicemails and recordings are not admissible in family law, when we indicated we have recorded evidence of verbal statements made by the other party.

Maybe a good practical solution for how to add it to the record, is to bring the recording to a notary and have a transcript made and sworn as an affidavit, so you can just include the sworn transcript, without worrying about burning to disc, etc.
