Need info

Hi I am new and have a question. My fiancee was married to a girl from the US who turned out too be a con and a drug user. She even went so far as to prostitute herself on craigslist. She is in jail in Texas and he has filed for divorce. She has not lived with him since July of 2008. How long after she signs can we get married? What is the next step if she refuses too sign? Which is probably what will happen.
