  • Advice on Common Law Property Division & Spousal Support

Looking for advice: Common law 4 years, bought a house through Home Buyers Plan with my RRSPs, put him on title (dumb!), found out after first year partner gambling his share, including mortgage payments, and using joint line of credit to gamble. He is out of house now for 9 months paying nothing. He is claiming for spousal support, works in construction and I made more each year together. I have been supporting my adult son since we met. I bought two cars, one for partner in my name so he had wheels to go to work, his credit too bad to buy one. Do I have a case for unjust enrichment? Can he get support from me?

IANAL but if he makes more than you, either provable or imputed, then his claim might not go through. I believe need, not just entitlement is considered in such claims
