    I know that cheating can not be brought up for the rest of the case, and I have no issues with that.

    However, I think I can use it to lower the spousal support. I don't think my ex has a claim for compensatory SS, since she has a better job now then before the marriage, and she's stronger financially and as far as her career then before.

    She might have a claim for non compensatory, however, as per the guidelines, when SS is awarded for non compensatory reasons, it can be lowered or ended when she moves in with her new spouse/significant other.

    My ex cheated on me, and moved out of the house and with her new partner.

    I don't have strong proof that she cheated, however, I do have proof that they moved in together.

    She moved in with someone which affected her need for SS. As you rightly say, the cheating part doesn't matter. Leave it out of your pleadings.
