  • Where to Find Help in Filling Out a Settlement Brief

    Does anyone know if there is a "tips" page or some sort of guideline that would help a self-representing party in filling out a settlement conference brief?

    Any help/advice is greatly appreciated.

    Specifically, how do you make an offer?

    Is there a format, special wording, etc., that needs to be used when filling out the form?

    Do you put what has already been settled (though not yet ordered or put in a written agreement) in an offer to settle or ask that the agreed-to changes be made?

    Do you have to put in all the issues brought forward in the original motion, or can you omit those that are no longer of importance or that have worked themselves out and no further action to alter their clauses is required?

      I don't think the Judges even read them prior.

      They are very straight foward. And sorry to tell you the judges I've had in the past don't even read them. You can tell because when you tell them about an item they have absolutely no clue. They only seem to want to hear what the support recipient has to say anyway.

        I agree. I've been there, biting my tongue and trying not to scream "Are you kidding me?!" at the judge during their blatant favouritism - as in, my husband, the payor had one thirty second opportunity to plead his case, whereas the recipient's lawyer spent a whole 5 minutes asking for more money, more money, more money. And in the end... that's what he got - regardless of my husband's unemployment and the amount listed in the child support tables. It was quite infuriating. But, we try, and try, and try again!
