    Is the presence of a separation agreement a prerequisite for a joint divorce?

    Not at all, but if there are kids involved the court will want to be satisfied that they are adequately taken care (i.e. support is agreed upon) before granting the divorce order.

      Kids are considered kids up to what age?

        Generally if the kids are still in school, then Child Support comes in to play. It can also apply to post-secondary education if one of the parents is supporting that child.

        Any outstanding property issues can be included in the agreement.
