    How do the courts view if one spouse is holding onto the hopes of reconcilation and the other not?

    Can the courts rule that before proceeding that marriage counselling be looked at, for potential welfare of the kids?

    PS - Yeah I know, a long shot, but ya never know.

    Actually, that is why one must wait the 1 year before being granted a divorce.

    As far as the courts, only one person has to want "out". I don't think it would make a difference to a judge. Judges job is to base their decision on the laws.

      Is the one year wait mandatory, or is it the choice of the 2 parties involved?

        The one-year separation is mandatory regardless.

          One year is a fair time. Anything less could not be considered completely "official" as things can happen within that year.
