    Hello first post lots of good info going back and forth, thanks

    Question, does anyone know the process for a case conference, I have one the last week of January and not to sure how they proceed and it is a difficult situation as we are still living in the same house (1yr)except when he stays at girlfriends on my weekend with the kids,

    The purpose of a case conference is to bring the parties and their counsel to court in order to define, narrow or even settle the issues in dispute.

      Hi Thank you, yes I was just wondering if they bring in the offers from both of us that have not been accepted--hence the reason for conference, and are the issues resolved that day?

        Best case scenario is the Judge will try and help both parties come to a resolution that day.

        Bad case scenario is both parties can't agree and feel that they would be better off going the next step, either a motion or trial then it will not be resolved at a case conference.

          I have been told by my lawyer that in a case conference no order can be made unless agreed upon. You have to have a case conference to get permission to go on to a motion. Don't always bank on things going a certain way though, I have had a Judge refuse to allow us to go to a Motion!
          I know in my area, they make you and your ex see a mediator at the court house prior to going into court. This may help, it may not. In my case, definately NOT!

            Did the judge refuse you going forward with a motion because you hadn't gone to mediation?

              Hi Grace,

              No we were told that mediation was no good to us because of the other factors in the case. Also because neither of us would move on items for discussion. Ie. the kids were not going to stay with a man that was a stranger to them and endure more abuse. We just got a Judge that day that happened to be in a bad mood I guess, and with my ex self representing, it did not help my side...... I am represented.
