    Hello Everyone,

    This might be an odd question, but I was wondering if the witness for both the husband and wife signatures on the Separation Agreement could be the same person? Or does there need to be 2 witnesses?

    The Family Law Act just says that the signatures must be witnessed; nowhere does it state that there needs to be 2 witnesses. So, you probably could get away with just 1 witness.

    1 witness might be risky in that there could be allegations of coersion, etc, which would invalidated the agreement. Given that a separation agreement is such an important document, if at all possible I wouldn't take the chance and would get two witnesses.

      I was sure 1 witness is enough.
      I know it is fine for other documents, however this particular situation may require two.

      I think it is worth finding someone else to act as witness in this case.
