Lost my job..but trying to get another one. How should i got about reducing my CS and SS without involving expensive legal fees

In theory, there are forms to fill out to do it on consent. You can probably call your FRO caseworker and find out. No cost at all.

In reality, recipients almost never voluntarily accept less money. You will likely have to go to court.

Further to Janus' very valid points.

How you were terminated REALLY matters as well. If you were terminated with cause you have less likelihood of success on reducing CS or SS. If you were relieved of your position due to organizational changes then you have a higher probability of success.

Furthermore, you shouldn't bring a motion until such time your income actually changes. (In other words, until the severance period is over and you are on EI.)

The court will expect you to find similar income and may impute an income against you. You simply can't quit or get "fired" with the expectations that you will not maintain your career objectives and level of income.

They also will be expecting you to find new employment and you are advised to keep DETAILED records of your efforts because it will be expected in any negotiations to reduce it and ORDERED by the court should you go down that path.

Loss of employment does not equal (!=) automagical adjustments to CS and SS. It is a change in circumstance but often this change is only temporary in nature and the court HATES when people come in asking for an immediate change when they could easily find employment during the severance period. It simply means that they are going to possibly have to deal with you again when you find employment.

My advice is to simply be MATURE about the situation and be REASONABLE.

      Good Luck!
