  • Urgent : Opinion Needed re Late Filing

    Good morning everyone. I am seeking advice on whether or not I should consent to allowing my ex's lawyer file their " Response Motion to Change and Financial Statement " . I am self rep .

    In October 2016 we had our first conference where my ex's lawyer requested an extension of 30 days to file their papers . I agreed .
    Those 30 days came and went and no action on their part .

    Fast forward to yesterday ( 3 months later ) when I receive their case conference brief and another request via email for me to consent to allow them to file late again as they have never filed any papers with the courts. They forgot .
    Our first case conference is this Wednesday .

    BTW, their brief is worded very intimidating and demanding even more than what I had been giving in the past and basically says " deny father everything, make him pay more and make him pay my lawyer fees as well ".

    My question is , should I consent to allow them to file late ?
    Does it make me look bad if I say No ?
    Is there any advantage for me to go forward as is ?
    The deadline is today at 2 pm.

    My ex has made me jump through many hoops so far to even get to this point and I do not want to blow it now .
    I need this process to continue as I also have a Revenue Canada tax case pending and CRA is not giving me any more delays .

    Anyone have any thoughts ?

    you answered your own questions when you said you need the process to continue.

      The judge in my jurisdiction generally adjourns the case and orders costs if their documents aren't filed on time.

        Hi Trinton and SOTS,

        Thank you for your responses .

        Since I am self rep, costs are minimal and an adjournment will delay something I have been waiting for since 2014 .

        If I consent, does it gain me any favor with the courts or do they typically expect these sorts of things ?

            What are the issues? Coincidentally enough, I have my first case conference meeting this Wednesday as well.
