    Hello everyone

    Since our separation the children(boys aged 7&8) have been having anxiety issues, they are not happy where they live (moms bf has three older boys that physically and verbally abuse them i.e. coming to me with visible bruises on face and body, they call them jerks, assholes and give them the middle finger, they are never punished). Called CAS to know what the kids rights are when my son came home with a bruised jaw and unable to chew for two days and they said nothing can be done as its a minor inflicting the pain and could be construed as rough play.

    Anyways, exchanges are extremely for my eldest, he constantly says he doesnt want to live with mom and refuses to go to her (bawling and screaming). I have asked for the kids to attend therapy since date of separation, through court and her, it went to deaf ears until my son made a spectacle at school and threw himself in front of my car trying to leave with me and not mom, mom decided its best the boys attend therapy which was great.

    That was two months ago, I have asked since what happened with the referral, she said she will call Dr's office to follow up but I never heard back from her even after I asked again. Finally called the Dr's office myself and they said there is no record of a referral and that the Dr never prescribed one (confusing as she said he did) so she is obviously lying.
    She has made me to look like the bad guy in court stating verbal and physical abuse backed by nothing, no one has custody but she has them 65% of time so i'm guessing de facto sole custody for her but I have been involved in taking them to Dr's, dentists, eyes appointments etc and during our first settlement agreement she agreed to joint custody and will only sign on it if I agree to a lower equalization payment so nothing decided yet.

    What do I do now? They go to an appletree and I have a family Dr, she refuses that the kids see my Dr as he is mine, do I go ahead with asking the Dr for a referral? Do I take this to court? Can I ask for sole custody based on not taking the kids best interest?

    She has a history of mental disorder specifically anxiety, Dr's diagnosis not mine, but she always refused therapy or meds including when CAS recommended that she attend therapy. I believe she is afraid of what the boys might disclose. So any help would be appreciated, dont have a lawyer, can't afford one.

    Get your kids to a pediatrician. Doesn't have to be your personal doctor. You can arrange this when the kids are with you. Pediatrician can then make referral for counselling if pediatrician determines it is necessary. By doing it this way there would be documentation which it sounds as though you need to make a move for custody.

      I would file a motion for sole custody/residency and get a private assessment done. The psychologist will interview both parties and kids and make a recommendation.
