  • Reasses divorce settlement

Hi everyone. I need some advice on what to do with my divorce settlement. My ex wife and I were together for 13 years, married for 2. We separated in November 2010 and shared custody and expenses for our son until I moved to Calgary in 2013 hoping to get a better income. my ex wife finally filed divorce papers in late 2014, with a court date for Jan 2015.

When she filed I was still living in Alberta and couldn't afford to be there for the court date. I also couldn't find any legal help out here since the divorce was filed in a different province and pretty much gave up any hope for the entire thing. I hadn't done my taxes for years, didn't respond to any of he paperwork and the settlement gave her everything she wanted, including child support that is higher than I can afford - she guessed what my salary was.

Fast forward a couple years and she hasn't let me or anyone in my family have access to my son, she says it confuses him too much - he's 13. She's now also asking for more money from me without going to the court, she wants to send me reciepts and have me send her the money.

What I'm wondering is if it's possible to go back to court and redo the divorce settlement nearly 2 years after the fact? I've stayed in contact either my son even though his mother won't let him speak with me and want to rebuild that relationship. I also want to reasses the support payments with what my salary actually is and has been since we separated. The problem though is I still live in Alberta and have minimal extra funds to be able to go to Ontario. Is it possible to file papers or have everything reviewed without being there?

    Thanks
