  • Summary Trials?

    After 3 years of litigation (this time), we have just completed the questioning prior to trial. It is clear my ex will not be complying with court orders (4) to produce financial disclosure.

    My lawyer has recommended that we go the Summary Trial route, as we will only be going to trial for financial matters.

    I am looking for some feedback on this. I can't seem to find too much information about how it's used or how effective it is in Ontario.

    I had a similar issue getting financial disclosure but my lawyer filed motions which my ex ended up losing and having to pay for.

    It sounds like the Summary Trial might be a more expensive process...although if your ex loses, he'll most likely end up picking up costs anyway. Does your lawyer want a special retainer for this?

      No, and from what I understand it's less costly than an actual trial. The Summary trial will be based on written material; however, unlike a Summary Judgement, gives judges more flexibility to provide ruling that forces people into an unnecessary trial process.

      In my case, my ex is on a path to cause financial damage; I have a lawyer, he's self-represented himself.

        Sounds like a good effective way to get what you need...especially since if your lawyer has requested disclosure and he's blown you off, he'll most likely pick up costs.

        I had 3 motions to get this done. I didn't have to attend or pay for any of them but it took more time than this probably will.
