  • Method of payment - bank e-transfer vs paypal vs FRO

    I'm the support recipient. Our endorsement states support payment on the 1st "by way of electronic bank transfer" and I am to provide him with bank details. This was in September and I provided a "void" direct deposit cheque right away. We signed a withdrawal from FRO at the courthouse.
    Over the past six months he has been late every time. One or two days - usually with the excuse that's it's the weekend and he didn't have time. Then he was late over a week - the excuse that he was away on vacation and didn't have computer access. But the payments have shown up immediately into my bank account.
    Today - Happy April Fool's - he's changed his method of payment and has sent via paypal. The notice from paypal states that I will received the funds by April 13. WTF? I've never used paypal. No idea how it works. Will there be fees charged to me. He just sent it to my email address so did not use bank information that I was ordered to provide him with.
    Not sure how to deal with this. He's self-employed - high income earner (over $200,000) and it burns him up to pay anything. I'm thinking I should have just gone with my instincts and registered this with FRO. But I'm told it can still be a nightmare dealing with a self-employed payor.
    Advice please!

    If your order has a dollar figure in it, FRO has no issue. If you expect him to have an increase in salary over the next few years FRO is an issue. He can still be late with FRO, they dont do anything until hes $3000 in arrears.

    Its obvious hes being an asshole. Just ignore his games and take the money. If he continues to play the late game then consider FRO but its a pain to get the order updated yearly if his income increases.

    If your kids are teens you only have a few more years of his stupidity. Hes only hurting himself by being a jerk.

      The order has a dollar figure and it's over $3,000 monthly. (high support payor) If he is late with FRO would that mean they would take action right away?
      I was planning on waiting to register with FRO until after this summer. We're examining his financials (and yes there is going to be a big fight so I've listed everything I can think of on the order for disclosure) and then will impute an income.
      I receive spousal as well as child support so this will be for at least the next 9 years of dealing with his crap.

      If an agreement says payment on the 1st it means the 1st right? Not you'll get it after it's no longer in banking limbo.
      I don't have a paypal account. How does this even work?

        I'm in school full-time right now and will be for the next couple of years. I count on the support to pay the bills so him jerking me around means no groceries.

          Signing up for a paypal account is free and simple. They put it in your bank account.

          If youre already seeing a lawyer, maybe ask what they think?

          FRO takes three months to set up so if youre going to do it, do it soon. Im not sure how they would do it if hes late a few days. They have their own administrative issues. Might be worth giving them a call and asking the question.

            Thanks - I've put a call in to both my lawyer and FRO. Hopefully will hear back from my lawyer today.
            We're in court for a motion in a few weeks with another issue (other items in the agreement that he has not followed through on) that he managed to adjourn for two months when he fired his lawyer and had to find a new one. You would think he would be on his best behaviour leading up to a court date.

              Keep a log of all of it. Judges dont like bad behaviour and if you can prove hes being a jerk, it wont bode well for him. Good luck!

                I'm actually thinking of sending him the following -

                "I received an email from Paypal today stating that you have made a payment through their company. As I do not have a Paypal account I am not able to receive this payment.
                Please forward funds through the agreed direct e-transfer with the banking details I provided to you in September per our agreement.
                These funds are to be received by end of day today or you will be considered in arrears and a motion will be brought to court to deal with the issue with costs."

                Again, so tired of dealing with this jerk and his games. Next month it will be "the cheque is in the mail"

                  Might be worth a shot. Like I said, keep a log of it all. See what FRO says. He may not like paying them so he would be hurting if it goes to that.

                    Fro is slow but eventually they get there. We have been a year messy with late, non and odd payment s. But now they have reported him to the credit bureau, issued a federal garnishment order for income refunds and a seizure and sale order on assets which means the local sheriff is now watching for house sale, cars etc. Plus it will be difficult to secure any type of loans. Also we are moving towards a income at source garnishment order.

                    Only time works. It's a good threat for him to smarten up.

                      If youre already going through a court process, ask your lawyer about having the cs ordered as a garnishment. Im not sure how it works but if you know where hes employed you may be able to have the money garnished off his pay. That way youre guaranteed to get it monthly at a set time right through FRO. It may not come on the first of the month but he wouldnt like having his employer know hes a deadbeat.

                        The problem is that he's self-employed. So no employer to garnish his cheques.
                        Once we get his income determined by the court (yes - I am expecting to have to take him to trial) then we'll have a final number to provide to FRO. Right now, it's still temporary support order. I think I'm going to get the FRO process started now and then they'll just inform him to send the payments directly to them. Even if it takes a few months and the amount has to change it will all be in their hands.
                        I have a call set up with my lawyer for monday.

                          I'm not sure why you would go through a motion.

                          There is an enforcement mechanism, it is called FRO. If him being late bothers you, then use FRO.

                          If you go to court, the obvious question will be "why didn't you just re-register with FRO?"

                          For the three months, if you have financial issues go to the bank and get a loan, and pay it back once he is caught up.

                            It sounds like you are getting a lot of money. Many CS recipients are talking $400 - $600 per month. If you are getting $0000's then Just agree upon an amount you can live on and move the on. Register it with FRO and they will do all the legal fighting to get it paid.

                            Registering with FRO and he not paying will get Credit Bureau and Sheiffs office involved and no one who is self employed wants that.

                              Yes - he is a high income earner so it is a great deal of money. I'm lucky that it means that I can afford to go back to school instead of having to take minimum wage job and have a low-income household.
                              He is still of the mind-set that all he earns is his - the monthly child and spousal support is taking his money - he complains constantly about it to anyone who listens. He's forgetting that his income is that high because I took on all other family responsibilities so he could concentrate on his career for the length of our marriage. We were in the same field 20 years ago and if I didn't take that time away from work I would likely have the same earning potential as he does now.
                              So I'm back to school and he pays support.
                              I have a call in to FRO and a case worker will return my call on Tuesday. There is a case number so the agreement was registered with them. We withdrew enforcement in September but I'll just re-register. Hopefully that means this shouldn't take as long as starting from scratch.
