    Question-If one spouse makes emotional abuse claims during mediation,is the other spouse's spousal support affected after?

    Are you married?
    Has one party filed for divorce based on mental or physical cruelty? (which people rarely do)
    Can the "emotional abuse" claim be substantiated? Has the substantiated "emotional abuse" prevented the recipient from earning income and can it be proven?

    If your answer is "no" then you are clearly off track in your mediation. Get back to number-crunching with a focus on SSAG.

      Are you describing a situation where one spouse claims they have PTSD (or similar) and cannot work as the result of abuse by their ex?

        I think it would only be relevant if it can be demonstrated that one spouse's actions have impaired or damaged the other spouse's ability to become economically self-supporting after the marriage ends. A formal diagnosis of PTSD or some other condition which interferes with daily life would probably be needed. Spousal support isn't really able to address the emotional damage of being in a bad marriage.
