  • Minimum time between changing an order on consent?

    Does anyone know if there is anything in the family law rules that states you cannot change an order on consent within so many months of the last change?

    I went to file a motion to change on consent and the court clerk seemed to think the judge would not accept it since the last change was about 4 months ago.

    A final Order cannot be varied within the first six months, except through appeal or exceptional circumstances.

    However, if it is on consent it should go through. Speaking to a local lawyer or duty counsel may help, as judicial discretion comes into play.
