  • finally...3.5 yr nitemare done

    April 22 at our 3 rd SC with same judge to help us to avoid a senseless trial... And we agreed on everything...
    May 15 I went back to oppose a couple tricks he tried and wording. The judge changed it.. she was all around amazing I feel... Had him send the agreement to her as u didn't have a lawyer and she was looking out for me
    I self repped towards the end as lawyers playing games. Pretty black and white I felt..

    She got exactly what I told her she would likely get 3.5 yr ago,and nothing her lawyer lied to her she would get.... Only cost her upwards of $26000

    Glad things are over for you. Did you end up having to give her 50% of the equity in the house? Her legal bills were 26,000.00?

      Yeah, spent 5 hr one day in court fine tooth combing our lives... I valued the house like 15000 more than its worth.. frig. Lol. Don't.Care. I can always make more money
      Thats the only think I didn't agree with.. used house value today's date. Not when she left.... Judge explained it... But I wasn't absorbing. That was in march hearing. LOL

      Yea... She was21000 3 SC ago... so it has to be up there. And her lawyer typed up the orders and separation agreement. Easily up there I bet

            My ex had a lawyer who didn't tell him what he wanted to hear...so he left that one and went to the next one that was a male-rights attorney...extremely high conflict. I think that lawyer telling my ex a bunch of crap was a large part of the reason that mine dragged on for so long. Finally he got rid of that lawyer after some pretty bad court proceedings didn't go his way and hired #3 who basically has pushed him to settle.

            Its just amazing to me that he would have done better if he had listened to me in the very beginning because I verbally offered him a much better deal...however, now that I've had to pay a fortune in unnecessary legal fees and custody evaluations....there is no deal. I am pursuing whatever I'm entitled to under the law.

            Some litigants will never listen to reason...

              Is this 3.5 years from the date of Application to the courts in your matter?

                    All negative advocate lawyers are a plague in the family courts. The "feminist" lawyers, "domestic violence" lawyers, "fathers rights" lawyers, and any lawyer who makes a gender war out of "family law" is a disgrace to their procession and the administration of justice.

                    Any lawyer operating on a "truism" be it "domestic violence", "gender bias", "sharp practice" (e.g. late service), "controlling allegations" etc... Are in my opinion all equally weighted as being "bad lawyers" in my personal opinion.

                      ^ I totally agree. I was surprised when I first started in family court that these piranhas were licensed to practice law and advertise their "isms."

                        Thank you Arabian. I don't think I'm going to recover what's been lost and I guess I think of it more as our kids money than mine. We've literally thrown a good university education down the toliet thanks to a lawyer who didn't tell the truth and caused a lot of conflict.

                        Total waste of money....even more importantly of time...and even more importantly, the damage that's been done has pretty much ensured that raising our children in a co-parent fashion will be difficult.

                        We still haven't settled equalization...so there's a bit more to come.

                        I agree. And if Canada was truly interested in making some reform to the family law process, the first thing they need to do is start getting these lawyers under control. ie. Start imposing penalties for lawyers/litigants who knowingly submit affidavits full of crap.

                        In addition, the MIP session should be in more than one session and more specific because litigants need to understand the realities of divorce. My ex actually believed he could get sole custody due to his male-rights attorney telling him so because I had a new bf....ridiculous.
